1. Acceptance

By accessing the site or using the service, you agree to these Terms, our Privacy Policy, and any order form, subscription, or written agreement that applies to your account. If you use the service for a company, you confirm that you are authorized to bind that company.

2. Service

CA Monk provides recruitment services and software for employer hiring workflows, including job management, candidate tracking, resume parsing, AI scoring, interviews, billing, documents, tasks, and analytics. Some features may be usage-limited by plan or credit balance.

3. Account responsibilities

• Provide accurate account, company, billing, and GST details.
• Keep login links, OTPs, and account access confidential.
• Use candidate data only for lawful hiring purposes.
• Do not scrape, reverse engineer, overload, or attempt unauthorized access to the service.
• Ensure your users have the right permissions for the data they access.

4. Candidate data and consent

Employers are responsible for the candidate data they upload, import, collect, or process through the portal. You must have an appropriate legal basis and any required notices or consents for resumes, assessments, interview recordings, AI evaluations, communications, and retention.

5. AI outputs

AI-generated scores, summaries, rankings, transcripts, and recommendations are decision-support tools, not guarantees of candidate quality or legal compliance. Human review should remain part of hiring decisions.

6. Payments, credits, and taxes

• Paid plans and credit top-ups are billed through Razorpay or another approved payment provider.
• AI actions consume credits according to the pricing shown in the product at the time of use.
• Consumed credits are not reversible once the AI action has run.
• Prices may exclude taxes unless stated otherwise. Invoices may include GST based on billing details.
• Plan limits and included credits may change prospectively with notice.

7. Cancellation and refunds

Subscription cancellation, renewal behavior, and refund terms are described in our Refund and Cancellation Policy. Unless required by law or separately agreed in writing, consumed credits, completed AI actions, and already-issued service periods are not refundable.

8. Confidentiality and security

Each party will protect confidential information using reasonable care. You are responsible for managing user access and promptly notifying us about suspected account compromise or unauthorized data access.

9. Intellectual property

CA Monk owns the service, software, workflow designs, content, and product materials. You retain ownership of your company data and candidate data, subject to the rights needed for us to operate and support the service.

10. Liability

To the maximum extent permitted by law, CA Monk is not liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability is limited to the fees paid by you for the service in the 12 months before the claim.

11. Governing law

These Terms are governed by the laws of India. Disputes are subject to the courts with competent jurisdiction in Mumbai, Maharashtra, unless a written agreement says otherwise.
